Il-qtil brutali ta’ Paulina Dembska u l-każijiet kontinwi ta’ vjolenza fuq in-nisa li ħarġu fid-dawl anke l-bieraħ filgħodu, fejn mara oħra nqatlet f’darha stess, u komplew jiġu amplifikati l-lakuni inkwetanti fis-sistema ta’ Malta. 

Il-PN jirrikonoxxi li minkejja li r-reat ta’ omiċidju volontarju f’Malta jġorr l-ogħla piena possibbli ta’ ħabs għal għomru, il-gvern għandu għall-inqas jimpenja ruħu f’riċerka li turi vantaġġi numerużi li jirrikonoxxi l-femiċidju bħala reat kriminali speċifiku. 

Il-fatt li l-femiċidju jiġi inkluż bħala reat speċifiku jiffaċilita l-monitoraġġ u l-istudju tal-femiċidju u s-sejba ta’ miżuri adegwati għall-prevenzjoni tiegħu, rispons rapidu, investigazzjoni adegwata u l-prosekuzzjoni u l-kastig tal-awturi. 

Minbarra rikonoxximent xieraq, investigazzjoni speċjalizzata ta’ każijiet ta’ femiċidju u t-taħriġ tal-infurzar tal-liġi u tal-prosekuturi tagħna hija meħtieġa wkoll. B'dan il-mod, ir-rikonoxximent leġiżlattiv tal-problema se jindika s-serjetà tal-kwistjoni u se jipprovdi l-impetu għall-progress futur fl-investigazzjoni tar-reati. 

Il-PN jappoġġja s-sejħiet ta’ diversi għaqdiet tad-drittijiet tan-nisa biex ir-reat tal-femiċidju jiġi rikonoxxut bħala reat fih innifsu, kif ukoll riforma fil-mod kif jiġu investigati l-femiċidji mill-bidu. Huwa meħtieġ li l-persuni responsabbli għall-investigazzjoni kriminali u l-prosekuzzjoni jirċievu taħriġ speċjalizzat fil-kawżi u ċ-ċirkostanzi li fihom isiru l-femiċidji. 

In-nuqqas kontinwu tal-Gvern li jirrikonoxxi li r-reati bbażati fuq il-ġeneru huma problema reali, u n-nuqqas sussegwenti li jittrattahom bħala tali, mhux se jwassal għal soluzzjonijiet reali. 

Dan huwa eżempju ieħor tan-nuqqas ta’ djalogu li jikkaratterizza l-gvern immexxi minn Robert Abela.

PN disappointed by Justice Minister Edward Zammit Lewis’ refusal to discuss the recognition of femicide as a crime in and of its own right 

The brutal murder of Paulina Dembska and the ongoing instances of violence against women coming to light even as recently as yesterday morning, where another woman was stabbed multiple times in her own home, has further amplified the worrying gaps in Malta’s system.   

The PN acknowledges that even though the crime of voluntary homicide in Malta carries the highest possible penalty of life imprisonment, the government should at the very least engage with research which shows numerous advantages of recognising femicide as a specific criminal offence.  

Having femicide included as a specific offence facilitates monitoring and studying femicide and finding adequate measures for its prevention, quick response, adequate investigation and the prosecution and punishment of perpetrators.  

In addition to proper recognition, specialised investigation of femicide cases and the necessary training of our law enforcement and our prosecutors is also necessary. In this way, the legislative recognition of the problem will indicate the seriousness of the issue and will provide the impetus for future progress in the investigation of the crimes. 

PN backs the calls of various women’s rights organisations for the crime of femicide to be recognised as an offence in and of itself, as well as a reform in the way femicides are investigated from the start. It is necessary that the persons responsible for the criminal investigation and prosecution receive specialised training in the causes and circumstances under which femicides are committed.  

Government’s continued failure to recognise that gender-based crimes are a real problem, and subsequent failure to treat them as such, will not lead to real solutions. 

This is yet another example of the lack of dialogue that characterises the government led by Robert Abela.
